Ⅰ 國際貿易案例
1.一般合同應規定溢短裝條款，比如容許實際交貨數量+/-3% 或+/-5%, 沒有規定的，慣例一般按5%掌握，由於你實際短少6%,超過了上限， 違反慣例，買方有權拒收，至於降價幅度，只能視客戶信譽程度，協商解決；
2.有部分灌裝24，代替了合同約定的30，雖然總細數正確，價格沒差別，但因為包裝不符合合同要求，顯然是違約的，只能協商解決，買方是有理由拒收的；
3.FOB條款，如果你及時向買方通知了裝船信息，則由買方投保，責任由買方承擔（買方再向保險索賠）；
4.租船不是你的義務，由於你方接受了客戶的委託，代為租船，卻沒有如期裝船，故責任在你方。除非你接受委託租船時，聲明不承擔是否能如期租船之義務，並得到客戶同意。
5.買方因為你方未及時通知裝船，導致沒有及時投保，造成的損失，由你方承擔，買方有理；
6.CIF,貨損發生在越過船舷之前，賣方有權索賠；
CFR ,FOB的投保人是買方，賣方無權索賠；
7.按保單約定及實際損失賠償。
8，A公司直接向代收行索取貨款。代收行可再向F公司索款。

Force Majeure：
Either party shall not be held responsible for failure or delay to perform all or any part of this agreement e to flood, fire, earthquake, draught, war or any other events which could not be predicted, controlled, avoided or overcome by the relative party. However, the party affected by the event of Force Majeure shall inform the other party of its occurrence in writing as soon as possible and thereafter sends a certificate of the event issued by the relevant authorities to the other party within 15 days after its occurrence.
18 仲裁：
在履行協議過程中，如產生爭議，雙方應友好協商解決。若通過友好協商未能達成協議，則提交中國國際貿易促進委員會對外貿易仲裁委員會，根據該會仲裁程序暫行規定進行仲裁。該委員會決定是終局的，對雙方均有約束力。仲裁費用，除另有規定外，由敗訴一方負擔。
Arbitration
All disputes arising from the execution of this agreement shall be settled through friendly consultations. In case no settlement can be reached, the case in dispute shall then be submitted to the Foreign Trade Arbitration Commission of the China Council for the Promotion of International Trade for Arbitration in accordance with its Provisional Rules of Procere. The decisions made by this commission shall be regarded as final and binding upon both parties. Arbitration fees shall be borne by the losing party, unless otherwise awarded.

fob風險到了香港，CFR風險到了德國。這兩種成交方式都是買方負責保險的。版
誰沒買誰倒霉。船公司有免責權條款，他只需進行少量賠償。至少可以肯定的是青島公司沒責任。11月20日，貨應該在香港和德國之間，德國買了保險找保險公司賠。否則，誰都不要陪賠。

Ⅶ 國際貿易案例分析
一般CIF價是賣方代辦保險，其保險險別是最低險別一般險。如合同中另有規定其他投保險別，賣方應按照合同中規定投保。針對上述案例，買方來電要求加保戰爭險，賣方可以代辦，費用由買方承擔。
