Ⅰ 国际贸易案例
1.一般合同应规定溢短装条款，比如容许实际交货数量+/-3% 或+/-5%, 没有规定的，惯例一般按5%掌握，由于你实际短少6%,超过了上限， 违反惯例，买方有权拒收，至于降价幅度，只能视客户信誉程度，协商解决；
2.有部分灌装24，代替了合同约定的30，虽然总细数正确，价格没差别，但因为包装不符合合同要求，显然是违约的，只能协商解决，买方是有理由拒收的；
3.FOB条款，如果你及时向买方通知了装船信息，则由买方投保，责任由买方承担（买方再向保险索赔）；
4.租船不是你的义务，由于你方接受了客户的委托，代为租船，却没有如期装船，故责任在你方。除非你接受委托租船时，声明不承担是否能如期租船之义务，并得到客户同意。
5.买方因为你方未及时通知装船，导致没有及时投保，造成的损失，由你方承担，买方有理；
6.CIF,货损发生在越过船舷之前，卖方有权索赔；
CFR ,FOB的投保人是买方，卖方无权索赔；
7.按保单约定及实际损失赔偿。
8，A公司直接向代收行索取货款。代收行可再向F公司索款。

Force Majeure：
Either party shall not be held responsible for failure or delay to perform all or any part of this agreement e to flood, fire, earthquake, draught, war or any other events which could not be predicted, controlled, avoided or overcome by the relative party. However, the party affected by the event of Force Majeure shall inform the other party of its occurrence in writing as soon as possible and thereafter sends a certificate of the event issued by the relevant authorities to the other party within 15 days after its occurrence.
18 仲裁：
在履行协议过程中，如产生争议，双方应友好协商解决。若通过友好协商未能达成协议，则提交中国国际贸易促进委员会对外贸易仲裁委员会，根据该会仲裁程序暂行规定进行仲裁。该委员会决定是终局的，对双方均有约束力。仲裁费用，除另有规定外，由败诉一方负担。
Arbitration
All disputes arising from the execution of this agreement shall be settled through friendly consultations. In case no settlement can be reached, the case in dispute shall then be submitted to the Foreign Trade Arbitration Commission of the China Council for the Promotion of International Trade for Arbitration in accordance with its Provisional Rules of Procere. The decisions made by this commission shall be regarded as final and binding upon both parties. Arbitration fees shall be borne by the losing party, unless otherwise awarded.

fob风险到了香港，CFR风险到了德国。这两种成交方式都是买方负责保险的。版
谁没买谁倒霉。船公司有免责权条款，他只需进行少量赔偿。至少可以肯定的是青岛公司没责任。11月20日，货应该在香港和德国之间，德国买了保险找保险公司赔。否则，谁都不要陪赔。

Ⅶ 国际贸易案例分析
一般CIF价是卖方代办保险，其保险险别是最低险别一般险。如合同中另有规定其他投保险别，卖方应按照合同中规定投保。针对上述案例，买方来电要求加保战争险，卖方可以代办，费用由买方承担。
